Data protection and privacy
Data protection declaration pursuant to Article 12 of the EU General Data Protection Regulation (GDPR)
of Bingen University of Applied Sciences (UAS),
both a public corporation and a state institution. This data protection and privacy policy also applies to the subdomain of Bingen UAS: http://mintplus.th-bingen.de (in German only).
(1) Bingen UAS takes the safeguarding of personal rights and your personal data very seriously. Your personal data will therefore always be collected, processed and stored in accordance with all legal data protection regulations. The procedures are based on the EU General Data Protection Regulation (GDPR), the State Data Protection Act of Rhineland-Palatinate (LDSG), Section 5 of the German Telemedia Act (TMG) and the German Act on Copyright of Works of Art (KunstUrhG). Please take the time to get informed by reading this declaration.
(2) Bingen UAS has a controller for data protection and a data protection officer to ensure data protection is carried out.

b) The data protection officer performs the functions and tasks in accordance with sections 37 – 39 of the State Data Protection Act of Rhineland-Palatinate.

The data protection officer is also the appointed transparency officer of the Bingen Technical University of Applied Sciences and therefore acts as the designated point of information according to § 9 (2) transparency law of Rhineland-Palatinate (LTranspG).
(3) Collection and processing of personal data
You can use the online services of Bingen UAS without disclosing your identity. Should we request personal data (such as name, address or e-mail address) on the website, e.g. as part of contact forms or registration, this is done on a voluntary basis. By voluntarily providing this data, you consent to the revocable use of the data by Bingen UAS.
This information is used for our own organisational purposes (for sending the requested materials/information to you, for example).
Once you have given your consent, e.g. for the purpose of sending a newsletter or other interesting information from our university, you can withdraw it at any time with effect for the future without stating any reasons. To do so, you can contact the officers named under (2) or another channel named within the newsletter.
Should you have any questions, we offer you the opportunity to contact us via the officers listed under (2).
(4) Cookies
This page uses cookies. Cookies are text files stored on your computer which allow an analysis of the use of our internet presence and automatically recognise you on your next visit. You can prevent the installation of cookies by setting your browser accordingly. This may result in you not being able to make full use of all of the services offered by TH Bingen.
(5) Logging
Logs are created and processed for statistical purposes each time the website is accessed, whereby the individual user remains anonymous:
- Referrer (page whose link you used to access this website)
- Keywords (with search engine as referrer)
- IP is evaluated to determine country of origin and provider
- Browser, operating system, installed plug-ins and screen resolution
- Time spent on the sites
The above data will be processed by us on the basis of our legitimate interest pursuant to Article 6 Para. 1 S. 1 letter (f) of the GDPR for the following purposes:
- To ensure a smooth connection of our internet presence,
- to ensure convenient use of our website,
- to ensure the obligation to provide information as a public institution,
- to ensure the efficiency of university communication,
- to evaluate system security and stability,
- and for other administrative purposes.
We reserve the right to subsequently check this data if we become aware of tangible indications of illegal use.
(6) Transfer of data
Personal data will not be transferred to third parties for commercial or non-commercial purposes without your express consent.
We only pass on your personal data to third parties if this is legally permissible (e.g. based on Article 6 of the GDPR) and/or necessary. The website of TH Bingen is hosted at our own computer centre. In some cases, we use service providers for commissioned data processing as required by law; the website is maintained by the company ‘LABOR - Agentur für moderne Kommunikation GmbH’. The full responsibility for the data processing remains with Bingen UAS. Moreover, we sometimes use plug-ins from other providers on our website; you will find more details about this below.
(7) Liability for own contents
The contents of these pages were created with the greatest diligence. However, we cannot assume any liability for the correctness, completeness and updated state of the contents. As a service provider, we are responsible for our own content on these pages in accordance with general laws.
(8) Liability for links (content of external providers)
Cross-references (links) to contents provided by other providers are to be distinguished from our own contents. We have no influence on their content; the respective provider or operator of the linked sites is always responsible for their content.
(9) Revocation, changes, corrections and updates
We hereby inform you that, pursuant to Articles 15 et seq. of the GDPR, under the conditions defined therein, you have the right of access to relevant personal data and to rectification or erasure, the right to restriction of processing, the right to object to the processing and the right to data portability. Pursuant to Article 77 of the GDPR, you also have the right to lodge a complaint with a data protection supervisory authority if you are of the opinion that the processing of your personal data infringes on this regulation. If the processing is based on Article 6 paragraph 1 letter (a) of the GDPR or Article 9 paragraph 2 letter (a) of the GDPR (consent), you also have the right to withdraw your consent at any time without affecting the lawfulness of the processing carried out based on the consent up until withdrawal.
(10) Right of access, Article 15 of the GDPR
You have the right to request information as to whether and to what extent your personal data will be processed (in particular the purpose of the processing, the recipient of the data, the duration of data storage etc.).
(11) Right to rectification, Article 16 of the GDPR
You have the right to request that your stored data be rectified if it is incorrect or incomplete. This includes the right to completion through supplementary statements or communications.
(12) Right to erasure (right to be forgotten), Article 17 of the GDPR
You have the right to request the erasure of your personal data. This is possible, for example, if the data is no longer required for the purposes for which it was collected or if the data is to be erased as a result of statutory obligations. In individual cases, however, this right may be excluded.
(13) Right to restriction of processing, Article 18 of the GDPR
You have the right to have the processing of your personal data restricted. This is possible, for example, if your data has been incorrectly recorded or the data processing is unlawful. If the processing is restricted, the data may only be processed in narrowly defined cases.
(14) Right to data portability, Article 20 of the GDPR
You have the right to request that the data relating to you be surrendered to you or to a person to be appointed by you in a commonly used electronic, machine-readable data format if you have provided this data yourself.
(15) Right to object, Article 21 of the GDPR
You have the right, for reasons arising from your particular situation, to object to the processing of your personal data at any time with effect for the future, provided that the data processing is carried out to safeguard legitimate interests (cf. Article 6 Paragraph 1 letters (e), (f) of the GDPR). In the event of your objection, we will check whether the legal requirements for the processing of your data are met and, if this is not the case, refrain from any further processing of your data.
(16) Exercising of the above rights
You may exercise the rights under No. 9 - 15 of this declaration by contacting the officers listed in No. 2 of this declaration. In principle, you can exercise your rights in text form or in written form towards Bingen UAS.
(17) Right to lodge a complaint with the responsible supervisory authority, Article 77 of the GDPR
You have the right to contact the responsible supervisory authority of the Union or the Member States at any time in the event of any infringements on data protection regulations.

(19) Changes to our data protection regulations
We reserve the right to amend this data protection declaration from time to time to ensure that it always complies with current legal requirements or to implement changes to our services in the data protection declaration, e.g. when introducing new services. Your next visit will then be subject to the new data protection declaration.
(20) Google Maps
To simplify your travels, we offer you the use of Google Maps, which displays maps and generates route planning. Google Maps is operated by Google Inc., 1600 Amphitheatre Parkway, Mountain View, CA 94043, USA. These subpages will be marked accordingly. By using this service, you consent to Google’s collection, processing and use of the data entered by you and collected while using this service. Our website uses plug-ins from the YouTube site operated by Google. The sites are operated by YouTube, LLC, 901 Cherry Ave, San Bruno, CA 94066, USA. When you visit one of our pages equipped with a YouTube plug-in, a connection is established to YouTube’s servers. This will tell the YouTube server which of our pages you have visited. If you are logged in to your YouTube account, you can allow YouTube to associate your surfing behaviour directly with your personal profile. You can prevent this by logging out of your YouTube account. Application is only possible after the applicant has taken mandatory note of the special data protection declaration for online applications and the revocable declaration of consent. During the enrolment process, the data will be collected, stored and processed by Bingen UAS. The collected and stored data may only be kept for as long as knowledge of the data is necessary, but for no longer than 60 years. The data will then be erased. If the application process is cancelled or the student is not enrolled, the data will be erased once the application phase has ended. Please take note of the special data protection declaration immediately at the start of the application process.
